Terms and Conditions

Venue Terms

These Terms govern your use of Hospo as a venue, business or organisation engaging hospitality workers for casual shifts in Ireland.

1. Who we are

Hospo is operated by Hospo Tech Limited (CRO 757604), a company registered in Ireland. In these Terms "Hospo", "we", "us" and "our" refer to Hospo Tech Limited. "You" and "your" refer to the venue, business or organisation accepting these Terms.

2. What Hospo is

Hospo is a digital platform that connects venues in the Irish hospitality sector with workers seeking casual shifts. Hospo is a connector and matching service. Hospo is not an employment agency in the legal sense, is not a labour-hire business, and does not employ, supply, second or assign workers to venues.

When a venue posts a shift on Hospo and a worker accepts it, a direct employment relationship is formed between the venue and the worker for the duration of that shift. Hospo is not a party to that employment relationship and has no role in the day-to-day direction, supervision or control of the worker.

4. Your role as the legal employer

When you accept a worker for a shift through Hospo, you are the legal employer of that worker for the duration of that shift. You are solely responsible for: Revenue registration and obtaining an RPN before the shift; operating PAYE, PRSI and USC; issuing compliant payslips showing gross and net pay; ensuring statutory entitlements (minimum wage, breaks, Sunday premium, public holidays, annual leave); health, safety and welfare under the Safety, Health and Welfare at Work Act 2005; right-to-work verification and Garda vetting where required; equal treatment under the Employment Equality Acts 1998–2015; and indemnifying Hospo against any claim arising from these obligations.

5. Posting shifts

When you post a shift you warrant that the role description, hourly rate, hours and location are accurate; that the rate meets or exceeds the National Minimum Wage; that the shift is a genuine offer of work; and that all information complies with the Employment Equality Acts.

6. Payments

Hospo facilitates the flow of payment from venues to workers through Stripe. You must pay the worker in full within seven (7) days of the shift being marked complete. Hospo charges a platform fee on the gross shift value. If you fail to pay within the 7-day window, your account will be automatically placed on hold. You must not pay a worker outside the Hospo platform for any shift arranged through Hospo.

7. Cancellation

The existing cancellation rules and cancellation window remain in force. Cancellation refers to the cancellation of a posted shift and is distinct from the 7-day payment rule.

8. Ratings and reviews

You may rate workers after a completed shift. Ratings must be honest, factual and not defamatory. Hospo may remove any review that breaches these Terms or applicable law.

9. Suspension and termination

Hospo may suspend or terminate your account, with or without notice, if you breach these Terms, fail to pay a worker within 7 days, attempt to circumvent the platform, are the subject of a credible worker complaint, provide false information, or remain dormant for 12 continuous months.

10. Limitation of liability

To the maximum extent permitted by Irish law, Hospo's total aggregate liability to you in any 12-month period is limited to the total platform fees you have paid Hospo in the preceding 12 months. Nothing excludes liability for death or personal injury caused by Hospo's negligence, fraud, or any other liability that cannot be excluded by law.

11. Data protection

Hospo processes your data in accordance with the Privacy Policy. Where you receive personal data of a worker through the platform, you act as an independent data controller in respect of that data.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email and via an in-app prompt requiring re-acceptance.

13. Governing law

These Terms are governed by the laws of Ireland, with exclusive jurisdiction in the Irish courts.

Worker Terms

These Terms govern your use of Hospo as a worker accepting casual hospitality shifts in Ireland.

1. Who we are

Hospo is operated by Hospo Tech Limited (CRO 757604). In these Terms "Hospo", "we", "us" and "our" refer to Hospo Tech Limited. "You" and "your" refer to you, the worker.

2. What Hospo is

Hospo is a digital platform that connects you with venues offering casual hospitality shifts in Ireland. Hospo is a connector and matching service only. Hospo is not your employer and does not supply your labour to venues. When you accept a shift, the venue is your legal employer for the duration of that shift.

3. Eligibility

By accepting these Terms you confirm that you are at least 18 years of age, have the legal right to work in Ireland, hold a valid PPS number, and that the information on your profile is true and accurate.

4. Your relationship with the venue

When you accept a shift on Hospo, the venue that booked you is your legal employer for the duration of that shift. The venue — not Hospo — is solely responsible for registering you with Revenue, operating PAYE/PRSI/USC, issuing payslips, paying you within 7 days, providing statutory entitlements, and providing a safe place of work. Report any failure to support@hospo.dev.

5. Your obligations

Provide accurate profile information; attend accepted shifts on time, sober and fit to work; follow reasonable instructions; behave professionally; declare relevant medical conditions; do not bring Hospo or the venue into disrepute; do not accept off-platform payment.

6. Payment

You will be paid the hourly rate stated on the shift listing, multiplied by hours worked, less the venue's lawful payroll deductions. The venue has 7 days from shift completion to pay you. Late payment triggers an automatic account hold for the venue.

7. Tax and your responsibilities

You are responsible for providing the correct PPS number, reviewing your payslips and Revenue records, and submitting an annual tax return if required. Hospo does not provide tax advice.

8. Your data

Your profile data, including your contact details, will be visible to venues that book you. By accepting a shift you consent to the venue receiving the personal data necessary for them to register you as an employee, pay you, and meet their obligations as your employer. See the Privacy Policy.

9. Ratings, reviews and conduct

You may be rated and reviewed by venues after each shift. Reviews must be honest. We may suspend or terminate your account for no-shows, consistently poor reviews, unsafe behaviour, attempts to bypass the platform, or false information.

10. Limitation of liability

To the maximum extent permitted by Irish law, Hospo is not liable for any loss, injury or claim arising from your shift, your interactions with the venue, or the venue's conduct. Hospo's total aggregate liability to you is limited to €100 or the platform fees Hospo has earned from your shifts in the preceding 12 months, whichever is greater.

11. Termination

You may close your account at any time via your profile or by emailing support@hospo.dev, or by using our web account deletion page.

12. Governing law

These Terms are governed by the laws of Ireland. The Irish courts have jurisdiction over any dispute, subject to your statutory rights as a consumer.

General & App Store Terms

These General Terms apply to every user of Hospo — workers, venues, and visitors — and apply alongside the Venue Terms or Worker Terms relevant to your role.

1. User-generated content and community standards

"UGC" means any content you submit to Hospo, including profile text and photos, venue listings, shifts, job posts, messages, reviews, ratings, CVs, and any other material. You retain ownership of your UGC. You grant Hospo Tech Limited a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display your UGC strictly for the purpose of operating the Service.

You must not post UGC that is illegal, defamatory, threatening, harassing, hateful or violent; sexually explicit, obscene, or directed at a person under 18; discriminatory on any of the nine protected grounds; infringing intellectual property; misleading or impersonating; spam; or malware/phishing.

Reporting, blocking and 24-hour response. Every user can flag any review, message, profile, listing or other UGC for moderation using the in-app report button or by emailing support@hospo.dev, and can block any other user. We commit to reviewing flagged UGC and acting on it within 24 hours.

2. Acceptable Use

You must use Hospo in accordance with our Acceptable Use Policy. Breach of the Acceptable Use Policy is a breach of these Terms.

3. Apple App Store provisions

The following provisions apply only when you download or use the Hospo iOS app from the Apple App Store. They are required by Apple Inc. ("Apple").

4. Real-world services outside the apps

All paid services on Hospo — including the venue platform fee, the 10% introduction fee, subscription fees, and the flow of wages from venues to workers — are payments for real-world services provided outside the mobile apps. They are processed via the Hospo website and Stripe. Hospo does not offer in-app purchases of digital content for in-app consumption. Accordingly, fees on Hospo fall within Apple App Store Review Guideline 3.1.3(e) and 3.1.5 (services consumed outside the app, and physical goods and services from third-party human providers) and are not subject to Apple's in-app purchase requirement.

5. Age confirmation

Hospo is an 18+ service. Workers must be at least 18 years old to register. By creating a worker account you confirm that you are at least 18. Venues must be operated by a person who is at least 18 years old and authorised to bind the business.

6. Intellectual property

The Hospo name, logo, website, mobile apps, branding, and the underlying software are owned by Hospo Tech Limited and protected by Irish, EU, and international intellectual-property laws.

7. Termination for convenience

You may close your account at any time from inside the app (Profile → Settings → Delete Account), via our web account deletion page, or by emailing support@hospo.dev. We may terminate or suspend your access to the Service at any time, with or without cause, on reasonable notice.

8. Disclaimers and warranties

Hospo is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Hospo Tech Limited disclaims all warranties, express or implied. Nothing in these Terms excludes or limits your statutory rights as a consumer that cannot be excluded under Irish law.

9. Force majeure

Neither party is liable for any failure or delay in performing its obligations to the extent caused by events beyond its reasonable control.

10. Notices

We may give notices to you by email, in-app message, or by posting on the Hospo website. You may give notices to us at support@hospo.dev or by post to Hospo Tech Limited, 16 Bawnouge View, Kilcock, Co. Kildare, W23 Y83K, Ireland.

11. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in whole or in part to an affiliate or in connection with a merger, acquisition, reorganisation or sale of assets.

12. Severability, waiver and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force. Failure to enforce any right is not a waiver. These Terms, the Privacy Policy, the Cookie Policy and the Acceptable Use Policy together constitute the entire agreement.

13. Governing law and jurisdiction

These Terms are governed by the laws of Ireland. The Irish courts have exclusive jurisdiction over any dispute, subject to your statutory rights as a consumer.

14. Changes to these General Terms

We may update these General Terms from time to time. Material changes will be notified to you by email and via an in-app prompt requiring re-acceptance.
